Terms of Use

Websites • landing pages and funnels • digital portals • learning experiences

Effective date: 14 October 2026    |    Version: 1.0

These Terms explain how you may use Volution’s online spaces and learning experiences, and how we respect the work, privacy and choices of everyone who participates.

1. Who we are

“Volution”, “we”, “us” and “our” refer to Angela Gail James, a sole proprietor trading as Volution and operating online through angelagailjames.com and related Volution-branded services. Volution is a trading name, not a separate incorporated legal entity. Our contact email is [email protected]. Our business address and any other legally required business particulars appear in the Contact section once completed. References to any earlier operating entity in superseded terms do not describe the current operator.

2. Where these Terms apply

These Terms apply to websites, landing pages, marketing funnels, online portals, learning journeys, courses, workshops, digital resources and related services operated by us, including services hosted by third-party technology providers on our behalf. They apply to visitors and registered participants. Some programmes, paid offerings, events or communities may have additional terms disclosed before enrolment or purchase. Where those specific terms conflict with these general Terms, the specific terms govern that offering to the extent of the conflict. Third-party services may also have their own terms.

3. Acceptance and eligibility

By using a Volution service, you agree to these Terms to the extent permitted by applicable law. Where account registration, enrolment or a purchase requires express acceptance, we will ask for it at that point. If you do not agree, please do not create an account or use the relevant service. You must have legal capacity to agree to the relevant offering; if an experience is intended for children or young people, we will provide appropriate age and parent or guardian arrangements separately before collecting their information.

4. Public access, accounts and learning journeys

Some material is freely available without registration. Other experiences require a free or paid account, or enrolment. For example, an introductory day of a journey may be accessible without an account, while saving progress and continuing may require registration. Availability and features can vary by experience. Account registration does not automatically enrol you in marketing communications or paid services. You agree to provide accurate account details, safeguard your login credentials and notify us promptly if you suspect unauthorised access. You are responsible for activity under your account to the extent reasonably within your control. We may use reasonable identity and security checks to protect your account.

5. Your private learning space and reflections

Your original journal entries, personal reflections and other personal writing remain yours. Creating an account does not transfer ownership of those materials to Volution. We use participant content only to provide, maintain, secure and support the relevant experience, and as otherwise explained in our Privacy Notice or expressly authorised by you. Other participants and ordinary website visitors cannot access your private journal entries through the participant interface. Authorised technical personnel or service providers may have limited access where genuinely necessary for maintenance, security, troubleshooting or support, subject to appropriate safeguards. No online system can promise absolute security. We will not publish, sell or use private journal entries for marketing. Feedback you choose to submit through a separate feedback function is handled separately, with its intended use explained when requested. Please avoid including another person’s sensitive information in your entries unless you have a lawful basis to do so.

6. Privacy and personal information

We process personal information in accordance with applicable South African law, including the Protection of Personal Information Act, 2013 (POPIA), and our Privacy Notice. The Privacy Notice describes the categories of information we collect, purposes and lawful grounds for processing, service providers, any cross-border transfers, retention, security, and how to exercise applicable rights. Please read it before registering. Account and service-related messages are distinct from optional marketing. Where consent is required for direct marketing, we will seek it separately and provide an appropriate way to withdraw it. You may contact us about access, correction, deletion or objections, subject to applicable legal requirements and exceptions. We cannot guarantee that deleting an account will immediately erase information we must lawfully retain or limited backup copies.

7. Our learning approach and appropriate use

Volution experiences invite reflection, learning and conscious participation. They are educational and developmental in nature and do not guarantee any particular personal, professional, financial or other outcome. Unless expressly stated, they do not constitute medical, psychological, legal, financial or other regulated professional advice. You remain responsible for your choices and for seeking appropriate qualified assistance where needed. Please use the services lawfully and respectfully. Do not harass others, impersonate people, interfere with the platform, attempt unauthorised access, introduce malicious code, scrape content at scale, or infringe the rights or privacy of others. Where an experience includes community spaces, additional community guidelines may apply.

8. Volution content, authorship and intellectual property

Angela Gail James is the creator and original author of the Volution frameworks, methodologies and original learning works she has developed. Copyright and other rights in Volution-provided text, course structures, graphics, audio, video, trademarks, designs, software and resources belong to their respective lawful owners. Some material may be licensed from third parties. Except where a separate licence expressly allows it, you receive a personal, limited, non-exclusive, non-transferable permission to access and use materials made available to you for your own participation and learning. You may not reproduce, redistribute, resell, commercially exploit, publish, adapt into competing products, or represent Volution materials as your own without prior written permission or another lawful entitlement. Nothing in these Terms restricts rights granted by applicable law. Your personal reflections remain your own, as described above. Any historical questions about rights held by a former entity should be resolved separately and are not determined by this statement.

9. Participant submissions, feedback and shared spaces

You retain ownership of original content you submit. Where you intentionally submit content for a shared discussion, testimonial or other public-facing feature, you grant us only the limited permission reasonably needed to display and operate that feature as explained at the time. We will seek specific permission before publishing private reflections or identifying you in promotional material. Feedback submitted through a designated feedback channel may be used to improve services; identifiable publication or promotional use requires an appropriate additional permission. You must have the rights necessary to share any content you submit and must respect the rights of others.

10. Free offerings, purchases and payment terms

Some Volution offerings are free; others may require a once-off fee, instalments, subscription or a separately agreed arrangement. Before a paid purchase, we will disclose the applicable price, currency, material features, payment frequency, any recurring charges, access period, cancellation method and relevant refund conditions. Payment may be processed by a third-party provider subject to its own terms and security arrangements. A free account or free learning journey does not create a payment obligation. If an offering has a recurring payment, we will explain how to stop future renewals before you subscribe. Nothing in these Terms excludes rights or remedies you may have under the Consumer Protection Act, Electronic Communications and Transactions Act, or other applicable law. Specific refund and cancellation conditions must be shown with each paid offering and must comply with applicable law.

11. Access, availability and changes to services

We take reasonable steps to keep our services available and secure, but uninterrupted access cannot be guaranteed. Maintenance, connectivity issues, platform changes or events outside our reasonable control may affect availability. We may improve, replace or discontinue features or offerings, taking reasonable account of existing commitments and applicable consumer rights. Where a material change affects a paid entitlement, we will provide information and remedies required by law or the relevant offering terms. We recommend keeping copies of any personal material that the platform allows you to export.

12. Third-party platforms and external links

Volution may use third-party hosting, authentication, communications, payment and learning technologies. Their involvement does not mean that we transfer ownership of your reflections to them. Their processing of personal information is addressed in our Privacy Notice and applicable agreements. Links to external sites are provided for convenience or context; we do not control their content or practices. Please review their terms and privacy notices before using them.

13. Suspension, account closure and retention

We may restrict or suspend access where reasonably necessary to protect users, investigate misuse, meet legal obligations or respond to a material breach. Where appropriate, we will explain the reason and offer an opportunity to resolve the issue. You may request closure of your account by contacting us or using any available account controls. Closing an account may end access to saved progress and materials. Requests to retrieve, export or delete reflections are handled according to available platform functionality, our Privacy Notice and applicable law. We will not promise a particular export or deletion feature unless it is actually supported and disclosed.

14. Responsibility and limits of liability

We aim to provide our services with reasonable care and skill. To the extent permitted by applicable law, we are not responsible for losses arising from circumstances beyond our reasonable control or from misuse of the services. We do not exclude or limit liability where doing so would be unlawful, including applicable statutory consumer rights or liability that cannot lawfully be excluded. Nothing here removes any right or remedy available to you under mandatory South African law. Any limitation of liability in offering-specific terms must be reasonable, clearly communicated and legally enforceable.

15. Complaints and resolving concerns

We welcome questions, concerns and complaints. Please contact [email protected] with a description of the issue so we can respond and seek a practical resolution. Privacy-related requests and complaints can also be made through the contact details in our Privacy Notice. You may have the right to approach the Information Regulator or another competent body where applicable.

16. Changes to these Terms

We may update these Terms as our services or legal requirements change. The current version and effective date will be displayed where the Terms are published. For material changes affecting registered participants, we will provide reasonable notice through an appropriate channel, and seek renewed acceptance where required. Changes will not retrospectively remove accrued statutory rights.

17. Governing law

These Terms are governed by the laws of the Republic of South Africa, subject to any mandatory rights and protections that apply. Disputes will be handled by courts or other competent bodies with jurisdiction under applicable law.
